1 Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and GuessToYes ("Company", "we", "us", or "our"), governing your access to and use of the GuessToYes platform, website, and all related services (collectively, the "Service") available at guesstoyes.com.

By creating an account, you are required to affirmatively accept these Terms and our Privacy Policy, which is incorporated herein by reference, by checking the corresponding box during registration. Your acceptance is recorded together with the version number of these Terms in effect at that time. By accessing or using any part of the Service, you acknowledge that you have read these Terms, understand them, and agree to be legally bound by them.

We reserve the right to update or modify these Terms at any time. When we make changes, we will assign the updated Terms a new version number. The next time you log in, you will be presented with a notice that the Terms have changed and will be required to affirmatively accept the updated version before continuing to use the Service. If you do not agree to the updated Terms, you may cancel your subscription in accordance with Section 10.2 and discontinue use of the Service.

2 Description of Services

GuessToYes is a web-based Software-as-a-Service (SaaS) platform that provides AI-assisted tools designed to help users with career preparation. The Service includes, but is not limited to:

• Resume Builder: AI-assisted generation and formatting of professional resumes tailored to user-specified target countries and job markets.
• ATS Optimizer: AI analysis of how well a resume matches a specific job description based on skills, experience, responsibilities, and education, including identification of gaps and rewording suggestions to better align resume language with the job posting.
• Cover Letter Generator: AI-generated cover letters tailored to specific job postings and user backgrounds.
• Interview Simulator: AI-generated interview questions based on job roles, with evaluation and feedback on user responses.
• Role Finder: Analysis of user background and experience to identify potentially suitable job categories and roles.
• Career Insights: AI-generated analysis including hiring probability estimates, career direction suggestions, and improvement recommendations.

All content, suggestions, scores, probability estimates, and outputs generated by the Service are produced by artificial intelligence and are provided for informational and educational purposes only. The Service does not constitute professional career counselling, legal advice, employment services, or any form of guaranteed job placement assistance.

3 User Eligibility

To use the Service, you must meet the following eligibility requirements:

• You must be at least 18 years of age, or the age of majority in your jurisdiction, whichever is greater.
• You must have the legal capacity to enter into a binding agreement.
• You must not be prohibited from using the Service under the laws of your country of residence or any applicable jurisdiction.
• If you are accessing the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

We reserve the right to refuse access to any person or entity at our sole discretion, including where we have reason to believe eligibility requirements are not met.

4 User Responsibilities

As a user of the Service, you agree to:

• Provide accurate, current, and complete information when creating your account and using the Service.
• Maintain the confidentiality of your account credentials and not share your login information with any third party.
• Notify us immediately at info@guesstoyes.com if you suspect any unauthorized access to your account.
• Use the Service only for lawful purposes and in accordance with these Terms.
• Be solely responsible for all content you submit to the platform, including resume content, job descriptions, and any personally identifiable information.
• Ensure that any content you provide does not violate the rights of any third party, including intellectual property rights or privacy rights.
• Review and verify all AI-generated outputs before using them in any actual job application, as GuessToYes does not guarantee the accuracy, completeness, or suitability of any generated content.

5 Acceptable Use Policy

You agree not to use the Service in any manner that:

• Violates any applicable local, national, or international law or regulation.
• Is fraudulent, deceptive, or misleading, including submitting false information or impersonating another person.
• Involves automated scraping, crawling, data mining, or any unauthorized extraction of data from the platform.
• Involves systematically testing, probing, or analyzing the Service's behavior or outputs with the intent to reverse engineer, replicate, or reconstruct GuessToYes's underlying methodology, models, or evaluation criteria.
• Attempts to gain unauthorized access to any part of the Service, its servers, databases, or related systems.
• Introduces viruses, malware, or any other harmful code to the platform.
• Interferes with or disrupts the integrity or performance of the Service or its infrastructure.
• Reproduces, duplicates, copies, sells, resells, or exploits any part of the Service for commercial purposes without our prior written consent.
• Uses the Service to generate content intended to deceive employers, misrepresent qualifications, or engage in fraudulent job applications.
• Circumvents, disables, or otherwise interferes with any security features of the Service.

We reserve the right to suspend or terminate access for any user found to be in violation of this Acceptable Use Policy, without notice and without refund.

6 Account Registration and Security

To access certain features of the Service, you must register for an account. When registering, you agree to provide truthful and complete information. You are responsible for all activity that occurs under your account.

You must not create accounts using automated means, create more than one account per person for the purpose of circumventing plan limits, or share your account credentials with others. Each subscription is for a single named user unless otherwise specified in writing by GuessToYes.

We reserve the right to suspend or delete accounts that are inactive for an extended period, used in violation of these Terms, or created with false information, without prior notice.

7 Intellectual Property Rights

7.1 Platform Ownership. The Service, including all software, algorithms, designs, user interfaces, text, graphics, logos, brand names, and all other content comprising the GuessToYes platform, is the exclusive property of GuessToYes and/or its creator and is protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws. These rights exist and are enforceable automatically from the moment of creation and do not depend on any formal registration, business incorporation, or notice requirement. Nothing in these Terms grants you any ownership rights in the platform, and all rights not expressly granted to you are reserved. Copying, reproducing, or creating a competing product based substantially on the Service is prohibited.

7.2 User Content. You retain ownership of the original content you submit to the platform, such as your resume text, personal background, and job descriptions ("User Content"). By submitting User Content, you grant GuessToYes a non-exclusive, worldwide, royalty-free, sublicensable license to use, process, store, and analyze your User Content solely for the purpose of providing and improving the Service.

7.3 AI-Generated Outputs. Content generated by the Service using artificial intelligence based on your inputs ("Generated Content"), such as resumes and cover letters, is provided to you for your own personal job search and career purposes. GuessToYes does not assert copyright ownership over Generated Content delivered to you, but makes no representations regarding its originality, accuracy, or suitability for any purpose. You assume full responsibility for any use of Generated Content.

Copyright and intellectual property protection for AI-generated content is legally unsettled and varies across jurisdictions. GuessToYes makes no representation or warranty that Generated Content is eligible for copyright protection, that you hold exclusive rights to it, or that it does not resemble content generated for other users or third parties. You use Generated Content at your own risk with respect to this legal uncertainty.

7.4 Confidentiality of Methodology. The specific methods, evaluation frameworks, scoring criteria, thresholds, prompts, decision logic, and other analytical techniques that GuessToYes uses to generate feedback, scores, recommendations, and any other output (the "Methodology") are proprietary and confidential to GuessToYes, regardless of whether any individual result derived from the Methodology is shown to you. You agree not to reverse engineer, systematically probe, test, or analyze the Service for the purpose of discovering, replicating, or reconstructing the Methodology, and not to use any insight gained from your use of the Service to develop, operate, promote, or assist any product or service that competes with GuessToYes. This obligation continues for as long as the relevant part of the Methodology has not become publicly known through no fault of your own.

7.5 Feedback. Any feedback, suggestions, or ideas you provide about the Service may be used by GuessToYes without any obligation of confidentiality, compensation, or attribution to you.

8 License to Use the Service

Subject to your compliance with these Terms, GuessToYes grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal job search and career preparation purposes.

This license does not include the right to: sublicense the Service to any third party; modify, adapt, translate, reverse engineer, decompile, or disassemble any part of the platform; create derivative works based on the Service; or use the Service in any manner not expressly permitted by these Terms.

This license is immediately revoked upon termination of your account or upon any violation of these Terms.

9 Payment Terms

GuessToYes offers both a free tier and paid subscription plans. By selecting a paid plan, you agree to the following:

• All fees are charged in United States Dollars (USD) unless otherwise stated at the time of purchase.
• Payment is processed securely through our third-party payment processor. GuessToYes does not store your payment card information.
• By providing payment information, you authorize GuessToYes to charge the applicable fees to your payment method on the billing cycle you selected (monthly or annual).
• All fees are non-refundable except as expressly required by applicable law or as stated in Section 10 below.
• We reserve the right to change our pricing at any time. Price changes will be communicated in advance and will take effect at your next billing cycle.
• Prices displayed may not include applicable sales tax, VAT, GST, or similar taxes. Where required by law, such taxes will be calculated and added to your payment automatically at checkout based on your billing location. You are responsible for any such taxes.

If a payment fails, we may suspend your access to paid features until payment is successfully processed. Our payment processor will attempt to retry failed payments according to its standard retry schedule.

10 Subscriptions and Cancellation

10.1 Subscription Renewal. Paid subscriptions renew automatically at the end of each billing period (monthly or annual) unless cancelled prior to the renewal date. By subscribing, you authorize us to charge your payment method on each renewal date.

10.2 Cancellation. You may cancel your subscription at any time through the billing portal accessible from your dashboard. Your subscription renews on the same calendar date each billing cycle as the date you first subscribed (for example, if you subscribe on the 9th, your next charge occurs on the 9th of the following month, or on the last day of a shorter month if that date does not exist). Cancellation stops future automatic renewal only; it takes effect at the end of your current, already-paid billing period, and you will retain access to paid features until that date. No partial refunds are issued for unused portions of a billing period.

10.3 Extra Usage Purchases. One-time extra usage pack purchases are non-refundable. Credits are added to your account immediately upon confirmed payment and expire at the end of the current calendar month.

10.4 Free Plan. The free plan may be modified or discontinued at any time at our sole discretion, with or without notice.

10.5 No Refunds. All payments are final. GuessToYes does not provide refunds, credits, or prorated amounts for any portion of a billing period, used or unused, regardless of when during that period you cancel and regardless of whether your plan is monthly or annual. This applies equally to a subscription cancelled one day after payment and one cancelled shortly before renewal.

11 Disclaimers

11.1 No Employment Guarantee. GuessToYes makes no representation, warranty, or guarantee that use of the Service will result in employment, job interviews, callbacks, salary increases, or any other specific career outcome. Employment decisions are made solely by employers and are influenced by numerous factors entirely outside our control. Any hiring probability scores or career outcome estimates generated by the Service are indicative scores calculated from your interview results and resume match, provided for informational purposes only, and must not be relied upon as predictions or guarantees.

11.2 AI Limitations. The Service uses artificial intelligence to generate content. AI-generated outputs may contain errors, inaccuracies, omissions, or content that is inappropriate, outdated, or unsuitable for a specific purpose. We strongly recommend that you review, edit, and verify all AI-generated content before submitting it to any employer or third party.

11.3 ATS Scores. ATS compatibility scores provided by the Service are AI-generated estimates of how well your resume matches a job description in substance (skills, experience, responsibilities, and education), not a simulation of any specific employer's actual screening software. We do not guarantee that a particular score will result in your resume being selected, shortlisted, or reviewed by any employer's applicant tracking system or hiring team.

11.4 No Professional Advice. Nothing on the platform constitutes professional career counselling, legal advice, HR consulting, or any other form of regulated professional advice. For professional guidance, consult a qualified career advisor or recruiter.

11.5 Availability. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

12 Limitation of Liability

This limitation applies regardless of whether such damages are based on warranty, contract, tort (including negligence), statute, or any other legal theory, and even if GuessToYes has been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law.

12.1 No Liability for Outcomes. GuessToYes provides AI-generated content, suggestions, scores, and estimates for informational and educational purposes only. GuessToYes bears no financial liability whatsoever, regardless of your subscription plan, for any claim relating to: failure to obtain employment, an interview, or any other career outcome; the quality, accuracy, or usefulness of AI-generated content, feedback, scores, or suggestions; the accuracy of ATS compatibility scores or hiring probability scores relative to any employer's actual systems or decisions; or any other outcome resulting from your use or interpretation of the Service's outputs.

12.2 Limited Liability for Service Failures. GuessToYes's liability is limited to the following situations only, and only where you provide verifiable technical evidence supporting your claim. An unsupported statement, screenshot, public post, or similar material, without such evidence, does not by itself establish liability:

• GuessToYes charged your payment method but failed to provide the corresponding paid access or feature, as confirmed by payment records;
• a confirmed security incident resulted in unauthorized third-party access to your data due to a vulnerability in GuessToYes's own systems (as opposed to the systems of GuessToYes's third-party infrastructure or AI providers), as confirmed by independent technical investigation, server logs, or confirmation from the relevant infrastructure provider; or
• GuessToYes failed to meet an explicit, written service commitment made elsewhere in these Terms.

GuessToYes is under no obligation to independently monitor for, detect, or discover such incidents, and liability under this Section 12.2 arises only once GuessToYes becomes aware of a claim meeting the above conditions.

12.3 Liability Cap. In any situation where liability is established under Section 12.2, GuessToYes's total cumulative liability to you shall not exceed the lesser of: (a) the total amount you actually paid to GuessToYes in the three (3) months immediately preceding the event giving rise to the claim, or (b) USD $50.00. Under no circumstances is GuessToYes obligated to refund subscription fees beyond this cap, and this Section does not create any right to a refund independent of the conditions in Section 12.2.

13 Indemnification

You agree to defend, indemnify, and hold harmless GuessToYes and its founders, officers, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of or access to the Service;
• Your violation of these Terms or any applicable law or regulation;
• Your violation of any third-party rights, including intellectual property rights or privacy rights;
• Any User Content you submit to the platform;
• Any misuse of AI-generated content produced by the Service;
• Any false, inaccurate, or misleading information you provide in connection with the Service.

GuessToYes reserves the right to assume exclusive control of the defense of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.

14 Privacy and Data Usage

Your privacy is important to us. Our collection, use, storage, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

In summary, we collect information you provide (such as your name, email, and resume content), usage data, and data from optional third-party authentication providers. We use this data solely to provide and improve the Service and do not sell your personal data to third parties.

By submitting resume content and personal information to the platform, you acknowledge that such data will be processed by our AI systems and by a third-party AI provider for the purpose of generating Service outputs. All data is processed in accordance with our Privacy Policy and applicable data protection laws.

14.1 AI Training. We do not use your resume content or other personal data to train, fine-tune, or improve any underlying AI model. Your content is sent to our AI provider solely to generate the specific output you requested and is handled according to that provider's own data policies.

14.2 Data Retention. We retain your account data for as long as your account remains active. If you delete your account, we will delete or anonymize your personal data within a reasonable period thereafter, except where we are required to retain certain records (such as payment records) for legal or accounting purposes.

14.3 Account Deletion. You may request deletion of your account and associated data at any time by contacting us at info@guesstoyes.com.

15 Third-Party Services

The Service integrates with and relies on third-party service providers to deliver its functionality. These include, without limitation:

• AI processing provider: Powers AI content generation, resume analysis, and interview simulation.
• Payment processor: Processes all payment transactions.
• Cloud hosting provider: Provides hosting and infrastructure for the platform.
• Database provider: Provides database services for user data storage.
• Email delivery provider: Handles transactional email delivery.
• Third-party authentication provider: Provides optional authentication.

Your use of these third-party services is subject to their respective terms and privacy policies. GuessToYes is not responsible for the practices, availability, accuracy, or content of any third-party service. We are not liable for any loss or damage arising from your use of or reliance on third-party services integrated with our platform.

The Service may contain links to external websites or resources. These links are provided for convenience only. GuessToYes does not endorse and is not responsible for the content, products, or services of any linked third-party website.

16 Service Availability and Modifications

GuessToYes strives to maintain high service availability but does not guarantee uninterrupted access. We may experience downtime due to maintenance, technical issues, infrastructure failures, or other causes beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service — including specific features, plan limits, AI models, or the platform as a whole — at any time, with or without notice. We will make reasonable efforts to notify users of significant changes in advance.

We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service or any part thereof. Your continued use of the Service following any modification constitutes your acceptance of the change.

17 Termination

17.1 Termination by You. You may terminate your account at any time by contacting us at info@guesstoyes.com or by cancelling your subscription through the dashboard. Termination of your account does not entitle you to a refund of any fees paid.

17.2 Termination by GuessToYes. We reserve the right to suspend or permanently terminate your access to the Service at any time, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent or harmful activity, or for any other reason we deem necessary to protect the Service, other users, or the Company.

17.3 Effect of Termination. Upon termination, your license to use the Service immediately ceases. We may delete your account data in accordance with our Privacy Policy and applicable law. Sections 7, 11, 12, 13, 18, and 19 of these Terms shall survive termination.

18 Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to binding arbitration or the competent courts of the Province of Quebec, at the election of GuessToYes.

You agree that any claim or cause of action arising out of or related to these Terms or the Service must be filed within one (1) year after the cause of action arose, or such claim shall be permanently barred.

Nothing in this section prevents GuessToYes from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.

Nothing in these Terms limits any rights you may have as a consumer under the mandatory, non-waivable laws of your own country of residence, to the extent such laws apply and cannot lawfully be overridden by agreement.

19 General Provisions

19.1 Force Majeure. GuessToYes is not liable for any interruption, delay, or failure in providing the Service caused by circumstances beyond the reasonable control of the affected party, whether that party is GuessToYes, you, or any third party involved in delivering the Service.

19.2 Severability. If any provision of these Terms is found to be invalid or unenforceable by a court or authority of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

19.3 No Waiver. Our failure to enforce any right or provision of these Terms at any time does not waive our right to enforce that same right or provision, or any other right or provision, at a later time.

19.4 Assignment. You may not assign or transfer these Terms or your account without our prior written consent. GuessToYes may assign or transfer these Terms, in whole or in part, including in connection with a sale, merger, reorganization, or transfer of the business, without restriction and without needing your consent.
